Welcome to the Aged Care Learning Information Solution (Alis). This online learning platform is provided by the Aged Care Quality and Safety Commission (the Commission).

By creating an account with Alis, you (which, unless otherwise defined in these terms and conditions, means an Alis account holder) agree to the following Terms and Conditions of Use (terms and conditions).

The Commission reserves the right in its absolute discretion to vary or amend these terms and conditions.  Amendments will be effective immediately upon publication. Your continued use of Alis following an amendment will constitute acceptance and agreement by you to be bound by the amended terms and conditions.

Commission subsidised Approved Provider and Service Provider accounts:

  1. For the purpose of clauses 1 to 8, the word ‘you’ means an Approved Provider or Service Provider, and the administrator of an Approved Provider account or a Service Provider account.
  2. Approved Provider accounts are available to Approved Providers (as defined in section 7 of the Aged Care Quality and Safety Commission Act 2018) of Commonwealth-funded home care, residential aged care and flexible care at no cost to Approved Providers (Approved Provider account).
  3. Service Provider accounts are available to providers of aged care services that form part of an Approved Provider, or provide -Commonwealth-funded aged care services on behalf of an Approved Provider, or as defined in section 8(3) of the Aged Care Quality and Safety Commission Act 2018 at no cost to the Service Provider (Service Provider account).  
  4. By creating and accessing an Approved Provider account or Service Provider account, you agree that you meet the definitions of an Approved Provider and a Service Provider, as stipulated in clauses 7 and 8 above.  
  5. By creating and accessing an Approved Provider or Service Provider account, you agree to not allow access to a Commission subsidised learner licence to an individual not employed or contracted by your organisation.
  6. By creating and accessing an Approved Provider or Service Provider account, you agree to remove access to Commission subsidised learner licences when individuals are no longer employed by your organisation.
  7. By creating and accessing an Approved Provider or Service Provider Account, you are responsible for managing all learner licences under this account.
  8. When creating an Approved Provider or Service Provider account, you agree that all personal information and contact details provided during the creation of the individual account, including but not limited to …, are current and accurate, and you agree to update the information and details in your account when circumstances change.  

Commission subsidised learner licences:

  1. ‘Learner licences’ are available to current employees or contractors of Approved Providers and/or Service Providers at no cost.
  2. Free access to online learning content in Alis (via learner licences) is only available to current employees or contractors of Approved Providers whose individual account is connected to their employer’s Service Provider or Approved Provider account.
  3. Free access is limited to online learning content only and does not include access to Commission education services such as facilitated workshops. The Commission reserves the right in its absolute discretion to revise, replace or remove the online learning content accessible via learner licences.
  4. The Commission reserves the right to charge a fee for access to a subset of content, including but not limited to Commission education services such as facilitated workshops.
  5. If an Approved Provider and/or Service Provider unlinks the holder of a Commission subsidised learner licence from their service, access to Alis content will be suspended until such time that full payment is received by the Commission for a paid licence or the learner is linked to their new employer.
  6. The creator of an individual account agrees that all personal information and contact details provided during the creation of the individual account, including but not limited to email address and contact phone number, are current and accurate, and agrees to update the information and details in the individual account when circumstances change.

Paid Licences:

  1. For the purpose of clauses 16 to 27, the word ‘you’ means an individual or organisation who is not an Approved Provider or Service Provider and therefore is not eligible to create an Approved Provider account or a Service Provider account, or an individual who is not employed by an Approved Provider or Service Provider and therefore is not eligible to access a free learner licence.
  2. You agree to pay the specified fee (incl. GST) to access the online learning content in Alis.
  3. When creating an individual or organisation account, you agree that all personal information and contact details provided during the creation of the account, including but not limited to email address and contact phone number, are current and accurate, and you agree to update the information and details in your account when circumstances change.
  4. Access to the online learning content in Alis will not be granted until payment is received in full via the online payment gateway.
  5. Access is limited to online learning content only and does not include access to Commission education services such as facilitated workshops. The Commission reserves the right in its absolute discretion to revise, replace or remove the online learning content accessible via learner licences.
  6.  All prices advertised on the Commission’s website regarding Alis are correct at the time of purchasing a licence.
  7. The Commission reserves the right to review and update the pricing structure for Alis and other Commission education services at any given time. Please refer to our website for updates.
  8. All pricing is inclusive of GST and provided in AUD. A tax invoice will be generated and issued to the email address linked to the account through which payment was made after payment for a paid licence has been processed.
  9. For paid licences linked in individual accounts, the licence is valid for 12 months from the date of purchase.
  10. For organisation accounts, payment of the first licence linked to the account triggers the commencement of a registration period which lasts for 12 months from the date of payment (registration period).  
  11. For organisation accounts, you accept that your organisation is required to pay the specified fee to access the online learning content in Alis for each licence linked to your account, even if the user of the licence does not complete the online learning content or leaves the organisation.
  12. For organisation accounts, you are responsible for managing all staff/ licence holders under this account.
  13. For organisation accounts, if you purchase additional licences during your registration period, a pro-rata amount for each subsequent licence will be charged.
  14. At the conclusion of your registration period, a renewal fee for each licence linked to your account (as specified on the Commission’s website) will be payable if you wish to continue to access the online learning content in Alis.

Cancellations:

  1. All cancellations for paid licences and Commission subsidised learner licences must be submitted in writing to the Commission: education@agedcarequality.gov.au.    
  2. Refunds will only be offered in exceptional circumstances. Refund requests must be submitted to the Commission in writing: education@agedcarequality.gov.au. An example of where a refund might be permitted is if the account has not been activated and the licensee is unable to access Alis.
  3. No substitutions or transfers of licences can be made as the learning record is attached to the individual account, rather than an organisation account, Approved Provider account or Service Provider account.

General Agreement:

  1. The online learning content and Commission education services available through Alis are intended to provide general information, education and guidance. While every effort has been made to ensure that information is accurate and up to date, the Commission does not guarantee the accuracy, completeness or currency of the information provided. The online learning content and Commission education services do not constitute legal, business or other professional advice. Users of Alis should seek their own legal, business or other professional advice as appropriate.
  2. By using communication features of Alis, you agree to not use or transmit offensive, obscene or defamatory language.
  3. You may not access or collect data from Alis using automated means, other than the provided reporting functions without prior written permission from the Commission.
  4. You may not attempt to access data through or from Alis that you do not have permission to access.
  5. The Commission reserves the right to remove or change online learning content from Alis that is deemed to be no longer relevant or required to be updated without notice to you.
  6. The Commission may limit user accessibility for maintenance without notice to you.

Privacy:

  1. The Commission is committed to protecting your privacy. We use the information we collect about you to maximise the educational content and services we provide to you.
  2. The Commission maintains strict online security measures. This is to ensure that Alis, and the information contained within Alis, is managed in accordance with the Privacy Act 1988 and to protect against cyber-attack, hacking, and unlawful access of confidential records.
  3. The Commission’s Privacy Policy (https://www.agedcarequality.gov.au/about-us/legislation-and-policies/privacy-policy) describes the information we collect from you and how this information is used. By accepting these terms and conditions, you also agree to accept the terms of our privacy policy.

Copyright:

  1. Content included on Alis, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software (content), is protected by copyright held by the Commonwealth or, if otherwise stated, a third-party supplier of information to the Commonwealth. Unless otherwise indicated, the Commission owns, licences or has permission to use the third-party content.
  2. You may not download, copy, modify, transmit, store, publish or distribute the online learning content or Commission education services available through Alis, nor facilitate or support users who do not have authorised access to the content under these terms and conditions without written permission from the Commission. Your use of or access to the content on Alis does not grant or transfer any rights, title or interest in the content.
  3. Requests and inquiries should be address to [insert email address].

Third party links or information:

  1. Alis may contain links to other third-party websites that are not related to the Commission and over which the Commission has no control or interest. The third party websites may contain content which is subject to that third party’s terms and conditions of use.
  2. The Commission is not responsible for the content, accuracy or opinions expressed in third party websites accessed by links through Alis, and does not investigate, monitor, or check these websites for accuracy or completeness. The inclusion of any linked website on Alis does not imply approval or endorsement of the linked website by the Commission.
  3. The Commission makes no warranties that the information contained on Alis or any links through Alis are safe, suitable or free of infection by computer viruses or other contamination. A user that leaves the Alis platform to access these third-party websites does so at their own risk.
